1. Acceptance of these terms
These Terms & Conditions form a binding agreement between you and Paon Bleu Inc., doing business as BOUSOL. By creating an account, accessing the website, downloading an application, or using a BOUSOL service, you agree to these terms and our Privacy Policy.
If you do not agree, do not use BOUSOL. Additional terms may apply to a particular product, promotion, partner, transaction, market, or enterprise service. If those additional terms conflict with these terms, the more specific terms control for that service.
2. Eligibility and availability
You must be at least 18 years old, or the higher age of majority required where you live, and legally able to enter into a binding agreement. You may use BOUSOL only where the service is available and lawful.
Products, assets, features, transaction limits, funding methods, cash-access options, and partner services vary by market and may change. We may decline, restrict, delay, or discontinue access when required by law, risk controls, partner requirements, or operational availability.
3. Account registration and verification
You must provide accurate, current, and complete information and keep it updated. We may require identity, address, source-of-funds, business, or other verification before or during your use of BOUSOL.
You are responsible for safeguarding your device, credentials, authentication methods, recovery information, and account access. Do not share credentials or allow another person to use your account. Notify us promptly at support@bousolapp.com if you suspect unauthorized activity.
4. BOUSOL services
BOUSOL may provide a digital wallet, supported digital-asset transfers, remittance receipt, holding and saving features, Sòl money-circle tools, supported cash access, and related services. BOUSOL Enterprise may provide payment collection, recipient management, approvals, disbursements, reporting, and audit tools.
BOUSOL is not a bank, and a BOUSOL balance is not a bank deposit. Unless a product-specific disclosure expressly states otherwise, balances are not insured by the FDIC, CDIC, or another deposit-insurance program. BOUSOL does not provide investment, legal, tax, or financial advice.
5. Wallet, blockchain, and digital assets
Some services use public blockchain infrastructure and supported digital assets such as USDC. Blockchain transactions may be irreversible once submitted or confirmed. Public records may reveal wallet addresses, amounts, timestamps, and other transaction information.
Digital assets involve risks, including software defects, network congestion, protocol changes, cyber incidents, issuer or counterparty failure, loss of access credentials, and changes in market value or redemption availability. A stablecoin is designed to track a reference asset, but its value is not guaranteed by BOUSOL.
You are responsible for checking wallet addresses, recipients, networks, assets, and amounts before confirming a transaction. BOUSOL may be unable to recover funds sent to an incorrect address, unsupported asset, or incompatible network.
6. Sòl money circles
Sòl provides tools that help people organize and participate in community money circles. Members decide whom to invite, contribution amounts, schedules, payout order, and other circle rules, subject to available product controls.
Participation depends on the actions of other members. BOUSOL does not guarantee that a member will contribute on time, that a circle will complete, or that a participant will receive an expected payout. Review a circle carefully and participate only with people you trust. You remain responsible for your commitments to other members and for resolving personal disputes that do not arise from a BOUSOL technical error.
7. Transactions, fees, and exchange rates
Before you confirm an eligible transaction, BOUSOL or the applicable provider will display available transaction details, which may include the amount, fees, exchange rate, recipient amount, and estimated timing. Review those details carefully.
Fees, limits, and rates may vary by service, asset, provider, payment method, market, and transaction. A transaction may be delayed, rejected, reversed where legally or technically possible, or subject to additional review. Estimates are not guarantees.
8. Cash access and third-party services
Cash-in, cash-out, settlement, identity verification, payment, communications, and other capabilities may be provided by independent third parties. Availability depends on the provider, location, eligibility, operating hours, liquidity, identification requirements, and applicable law.
A third party may require you to accept its own terms and privacy policy. BOUSOL is responsible for its own services but does not control an independent provider’s systems, locations, decisions, fees, or service interruptions. References to a provider do not make that provider responsible for all BOUSOL services.
9. Acceptable use
You may not use BOUSOL to:
- Break any law, regulation, sanctions restriction, court order, or third-party right.
- Commit fraud, money laundering, terrorist financing, theft, deception, or other unlawful activity.
- Use another person’s identity, account, device, or payment method without authorization.
- Send funds connected to prohibited goods, services, persons, countries, or activities.
- Interfere with security, access controls, networks, software, or other users.
- Reverse engineer, copy, scrape, resell, or exploit BOUSOL except as permitted by law or written agreement.
- Provide false information, evade limits, create duplicate accounts to avoid controls, or conceal the nature of a transaction.
10. Compliance, holds, and account restrictions
We may monitor activity and use automated or manual controls to manage fraud, security, sanctions, legal, and operational risk. We may request information, place a hold, limit features, reject a transaction, suspend an account, or report activity when we reasonably believe it is necessary to protect users, comply with law or partner requirements, investigate a violation, or manage risk.
Where permitted, we will provide information about a restriction and any steps available to you. We may be unable to provide details when prohibited by law or when disclosure could compromise security or an investigation.
11. Taxes and records
You are responsible for determining and meeting any tax, reporting, licensing, or recordkeeping obligations that apply to you. BOUSOL may provide transaction information but does not determine your tax treatment or file on your behalf unless expressly agreed in writing.
12. Intellectual property
BOUSOL, its applications, site content, software, designs, trademarks, logos, and other materials are owned by Paon Bleu Inc. or its licensors and are protected by applicable intellectual-property laws. These terms give you a limited, personal, revocable, non-exclusive, non-transferable right to use BOUSOL for its intended purpose.
If you submit feedback, you allow us to use it without restriction or compensation, provided we do not publicly identify you without permission.
13. Privacy and communications
Our Privacy Policy explains how we collect, use, disclose, and protect information. By using BOUSOL, you agree to receive service, security, legal, and transaction communications electronically. You are responsible for keeping your contact information current.
14. Service changes and termination
We may update, add, remove, suspend, or discontinue a feature or service. We may terminate or suspend your access if you violate these terms, create risk, fail verification, or if continued service is unlawful or unavailable.
You may stop using BOUSOL at any time. Account closure remains subject to pending transactions, legal holds, record-retention requirements, unresolved obligations, and any steps required to withdraw or transfer supported assets.
15. Disclaimers
To the fullest extent permitted by law, BOUSOL is provided “as is” and “as available.” We do not guarantee uninterrupted access, error-free operation, a particular transaction time, continued support for an asset or provider, or the actions of another user or third party.
Nothing in these terms excludes a warranty, right, or remedy that cannot legally be excluded under applicable consumer law.
16. Limitation of liability
To the fullest extent permitted by law, Paon Bleu Inc. and its affiliates, officers, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, opportunity, or digital assets, arising from your use of or inability to use BOUSOL.
Any limitation applies only to the extent permitted by applicable law. Some jurisdictions do not allow certain exclusions or limitations, so part of this section may not apply to you.
17. Your responsibility for claims
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Paon Bleu Inc. and its affiliates, officers, employees, contractors, and agents from third-party claims, losses, and reasonable costs arising from your unlawful use of BOUSOL, your material breach of these terms, or your violation of another person’s rights.
18. Governing law and disputes
These terms are governed by the laws applicable to Paon Bleu Inc. and the BOUSOL service you use, without regard to conflict-of-law principles, subject to any mandatory protections in your place of residence.
Before filing a formal claim, contact support@bousolapp.com and give us a reasonable opportunity to address the issue. Product-specific or enterprise agreements may contain additional dispute-resolution and governing-law provisions.
19. Enterprise and institutional users
If you use BOUSOL on behalf of an organization, you represent that you have authority to bind that organization. A signed enterprise, pilot, partnership, or program agreement controls over these terms where it addresses the same subject. Administrators are responsible for assigning appropriate access and permissions to their teams.
20. Changes to these terms
We may update these terms as BOUSOL, applicable law, our partners, or our services change. We will post the revised terms and update the effective date. When required, we will provide additional notice or request renewed acceptance. Continued use after the effective date means you accept the revised terms.
